Terms of Service

These terms are the agreement between you and Luminbrane AB for using Luminbrane Whiteboard ("Whiteboard"). We've tried to keep them short and readable. By creating an account or using Whiteboard, you agree to them.
The short version
- What you put on a board is yours. We host it and look after it.
- Whiteboard is free for now. It comes as it is, with no uptime promise (no SLA).
- Keep your own copy of anything important.
- Play fair: nothing illegal or harmful.
- We may use usage data to understand and improve Whiteboard, as the Privacy Policy explains.
1. Who we are
Whiteboard is run by Luminbrane AB (org.nr 559523-4245), Slottsbacken 8, 111 30 Stockholm, Sweden. You can reach us at [email protected].
2. Your account
- You need to be at least 16 to use Whiteboard.
- Use an email address that's yours. Keep your sign-in (email, password and authenticator app) to yourself. You're responsible for what happens on your account.
- If you think someone else has got in, use Sign out everywhere on your account page and tell us.
3. Your content is yours
- You keep all rights to the notes, drawings, files, comments, logos and images you add ("your content").
- You give Luminbrane permission to store, copy, process, transmit and display your content, but only so far as we need to run Whiteboard for you and the people you share it with, and as the Privacy Policy describes. This permission ends when your content is deleted, apart from short-lived backups and logs.
- A board belongs to its owners. They decide who has access, and they can remove content or delete the board, including content other members added.
- You're responsible for your content and for having the right to share it. That includes any personal data about other people that you put on a board.
4. Play fair
Don't use Whiteboard to:
- break the law, or infringe anyone's rights, privacy or intellectual property;
- upload malware or anything meant to cause harm;
- harass people or post hateful or abusive content;
- probe, attack or get around Whiteboard's security, or use another person's account;
- overload the service, scrape it, or use it as a file host for distributing content to the public.
If content or an account breaks these terms, we may remove the content or suspend the account. Where it's reasonable, we'll tell you first.
5. Free, as is, and without an SLA
- Whiteboard is free for now. If we ever introduce paid plans, we'll tell you in advance, and nothing will cost you money unless you choose it.
- Whiteboard is provided "as is" and "as available". We work hard to keep it running and your data safe, but we don't promise that it will always be available, error-free or fit for a particular purpose. We don't offer a service level agreement (SLA) or guaranteed backups.
- Keep your own copies of anything you can't afford to lose. You can download your data from your account page.
- We may change, pause or remove features, or shut Whiteboard down. If we shut it down, we'll try to give at least 30 days' notice so you can take your data with you.
6. Privacy and data protection
- The Privacy Policy explains what we collect and why.
- For personal data that you or your board members put on boards, you (or your organisation) are the controller, and Luminbrane processes it on your behalf as a processor under the data processing terms in section 11.
- For account data, security logs and usage data that we use to run, secure, analyse and improve Whiteboard, Luminbrane is the controller.
7. Liability
- As far as the law allows, Luminbrane is not liable for indirect or consequential loss. That includes lost data, lost profits, lost business and interruptions, and harm caused by content other users add.
- As far as the law allows, our total liability to you for anything to do with Whiteboard is limited to the greater of what you paid us in the 12 months before the claim and SEK 500.
- Nothing in these terms limits liability that the law doesn't allow us to limit, such as liability for intent or gross negligence, or your mandatory rights as a consumer.
- If someone makes a claim against Luminbrane because of your content or because you broke these terms, you'll cover our reasonable costs of dealing with it, as far as the law allows.
8. Ending things
- You can stop using Whiteboard at any time, and you can delete your account on your account page.
- We may suspend or close an account that breaks these terms, or close accounts if we shut Whiteboard down.
- Sections 3 (on content already shared), 7, 10 and 11 continue after the agreement ends.
9. Changes
We may update these terms. If a change matters, we'll tell you by email or in Whiteboard at least 14 days before it applies. If you keep using Whiteboard after that, you accept the new terms. If you don't agree, you can delete your account.
10. Law and disputes
Swedish law applies, and disputes go to the Swedish courts, starting with Stockholm District Court (Stockholms tingsrätt). If you're a consumer, you keep any mandatory protection your home country's law gives you.
11. Data processing terms
These apply where Luminbrane processes personal data on your behalf (GDPR art. 28). Luminbrane:
- processes it only to provide Whiteboard as these terms and your use of the service instruct, unless the law requires otherwise;
- makes sure that anyone at Luminbrane with access to it is bound by confidentiality, and gives access only when needed for support you ask for, for security or to comply with the law;
- protects it with appropriate technical and organisational measures (see "Security" in the Privacy Policy);
- uses the sub-processors listed in the Privacy Policy, which you authorise in general. We'll update that list before adding or replacing a sub-processor. If you object, you can stop using Whiteboard;
- helps you meet data subjects' requests, mainly through the export, edit and delete tools in Whiteboard;
- tells you without undue delay if it becomes aware of a personal data breach affecting your data;
- deletes the data when you delete it, or when the board or account is deleted, apart from short-lived backups and logs;
- gives you the information you reasonably need to show compliance with art. 28.
